It is my pleasure to inform you all that the first ETF Passenger Equipment Safety Standards rule, also known as the “Tier III Rule,” is now officially published as a final rulemaking. This means that, as of today, the US passenger rail industry can start to make use of the many long awaited provisions within the rule, without need of a waiver or special approval.

Let me be the first to say “thank you” to each and every one of you for your hard work and participation in this process over the years through Engineering Task Force (ETF) and the Railroad Safety Advisory Committee (RSAC). It is because of your input and effort that we have a comprehensive set of new safety standards that represent a truly collaborative effort. The process has not always been smooth, and I’m sure many of you have shared my frustration in the agonizingly slow process that followed since the ETF reached agreement on the original draft ruletext on May 30, 2013. This time has let us focus on our next endeavor, however, as we continue work on a second complimentary rulemaking, and proves that all of your hard work does eventually pay off.

I know many of you have questions about what the re-chartered format of RSAC will mean for our group, but as we learn more in the coming months, I encourage you all to stay involved in whatever ways you can. The railroad industry has always found success when individuals have come together to share their expertise and experience in a collaborative way, from the Master Car Builders Association and the American Railway Association in its first century, to the many associations and groups that have come since. ETF has continued this success and is a prime example of how collaborative rulemaking can bring about effective regulation for now, and future generations. This can only be achieved through the efforts of individuals such as yourselves, notwithstanding the many long hours, and for our many of our international participants, many long flights.

I want to wish a joyous holiday season to all of you and your families, and a Happy Thanksgiving to those of you in the US…and if we do not speak beforehand, a Merry Christmas and very successful New Year.
