So, the Kansas Constitution actually doesn't actually prohibit this. KDOT has often brought it up in a paltry effort to discourage, though in recent months KDOT officials have toned this down because they are now recognizing that city councils and chambers of commerce have organized as a corridor communities coalition with the support and endorsement of a number of legislators. The State DOT has traditionally brings it up, and states it in a way that lets the average citizen thinks there is a prohibition, but therre really isn't (when you read it actually is a provision). This same article in the Constitution applies to highway construction as well (and the state builds highways), once again with a 2/3rds affirmative vote in both Legislative houses.
