PullmanCo Member # 1138	posted Hmmm. Well, this case went to the Supreme Court, and came back. The DC Circuit ruled, given Amtrak is a governmental entity from USSC. It decided a regulator, who is also a competitor, violates the Takings clause of the Fifth Amendment. The District Court was reversed. Here's the opinion, if you want to read it. The Court actually quotes Steinbeck in East of Eden.
