The DOT has sided with Amtrak, not the Surface Transportation Board, regarding how to measure on time performance.

The Dept. of Transportation agrees that measuring timeliness should occur at intermediate points, along an Amtrak route, not just arrival time at the end of a route:

Well, the STB is is the regulator, so at the end of the day, its view counts.

Hmmm.

Well, this case went to the Supreme Court, and came back. The DC Circuit ruled, given Amtrak is a governmental entity from USSC.

It decided a regulator, who is also a competitor, violates the Takings clause of the Fifth Amendment. The District Court was reversed.

Here's the opinion, if you want to read it. The Court actually quotes Steinbeck in East of Eden.
